TERMS & CONDITIONS
1.1 By making a purchase from our website or from Hay Hampers Ltd by phone, email or in writing you agree to be bound by the Terms and Conditions at the time of the transaction.
1.2 All orders received are subject to acceptance by Hay Hampers Ltd. and Hay Hampers Ltd. reserve the right to reject any order without giving reasons. No contract to supply goods or services to you will come into existence unless Hay Hampers Ltd. dispatch goods or provide services to the purchaser or otherwise communicate to the purchaser our acceptance of an order.
1.3 All goods remain the property of Hay Hampers Ltd. until they have been paid for in full.
2.1 Hay Hampers Ltd. reserves the right to update these Terms and Conditions from time to time and any changes will be shown on the website(s).
3.1 Hay Hampers does not disclose buyers or recipients information to third parties, without consent, other than required service companies such as couriers. See our privacy notice for more details regarding consent and data handling.
3.2 Hay Hampers Ltd. do not telephone private customers unless information is required about an order.
3.3 If you consent to receive marketing communications, Hay Hampers Ltd. will send information, discounts and promotions via marketing channels. Hay Hampers Ltd. corporate customers will be contacted on a regular basis, unless instructed otherwise. You can be removed from specific communications or marketing channels at any time. Contact [email protected] if assistance is needed with this.
4.1 All information in the Checkout and Payment area will be fully encrypted using the latest Secure Socket Layer security technology. All data sent to our server and the data returned to you is encrypted via an encrypted connection. To view the security certificate click the Comodo icon. Pages viewed in secure areas show https:// (s = secure) with a yellow padlock icon.
5.1 To be eligible to purchase goods on the website(s) and lawfully enter into and form contracts with Hay Hampers under English law you must:

5.3 Register your real name, address, phone number, e-mail address and any other details requested.
5.4 By offering to purchase goods and services you authorise us to transmit information (including updated information), and to obtain information from third parties, including but not limited to, administrators of the payment method selected.
5.5 It is a criminal offence to purchase or attempt to purchase goods with a stolen credit card, or with stolen personal details, or with a false name. Hay Hampers Ltd. will take appropriate action if Hay Hampers Ltd. discovers any fraudulent attempts to purchase goods from our website.
5.6 Hay Hampers Ltd. reserves the right to withhold goods and terminate any account details wherein Hay Hampers Ltd. suspects fraudulent practice and/or breach of these terms and conditions.
5.7 You warrant that the personal information which you provide at registration or subsequently is true, accurate, current and complete in all respects; and you are not impersonating any other person or entity.
6.1 A full list of contents is given for each gift. Photographic props such as glasses, cups, plates, wooden boards, knives and stands, cake stands, flowers and fruit etc. are not included, unless otherwise stated in the list of contents. Please also see the substitution paragraph.
6.2 For gifts containing fresh perishable goods such as cheese, smoked salmon, ham, pork pies, sponge cakes and others, please be aware that ordering these items early for an occasion and storing them, you MUST take these items out of the hamper and store them in a refrigerator on receipt. The minimum guaranteed shelf life of the smoked fish is from 14 days, cheese from 7 days and pork pie 4 days. Scones are best be consumed on the day of receipt and these and sponge cakes have a shelf life of 5 days. If you are purchasing a Christmas hamper, the minimum shelf life will typically be 7th January. Hay Hampers Ltd. recommend ordering with a dated delivery for point of requirement or ordering one of our non-perishable long shelf life gifts if ordering early and storing.
6.3 Once your order has been placed, the summary order details will be emailed to you. Please ensure you are happy with the details at this point. If you do not receive this email please check your junk mail inbox, add [email protected] to your safe contact list and if this does not work, contact us. A dispatch email will be sent to the provided email once your order has left with the courier.
6.4 Before placing your order, you should carefully read the Terms and Conditions. Please tick the box to confirm you have done this.
6.5 Whilst Hay Hampers Ltd. makes every effort to supply items described in our detailed listings, in the event of supply difficulty, it may be necessary to substitute goods of an equal or higher value. Gifts containing Christmas items ordered during the rest of the year will automatically have these items substituted unless otherwise requested. Some wine vintages may be substituted according to availability throughout the year.

7 Corporate Orders
7.1 Discounts may be available for large volume orders if contact is made directly with Corporate Sales staff and this agreement is decided.
7.2 Personalised and branded goods and hampers with bespoke (otherwise unstocked) components. Please note that from the time of receiving your written order Hay Hampers Ltd. will purchase component parts relating to your hamper and these orders cannot be cancelled.
8.1 We have the right to cancel orders up to the day of despatch when a full refund will be credited.
8.2 For online purchases, the customer has the right to cancel an order up to 14 days after receipt of goods. Please see section 8.3 for exceptions. Where this right is exercised you will be refunded the full amount minus the price of the food and drink items which cannot be resold as well as carriage charges incurred. All goods must be returned in a good resalable condition. Hay Hampers Ltd. aims to provide the refund within seven days on receipt of returned goods, less any charges as stated above. Notification of cancellation must be in writing - letter or email. Cost of return to be paid by the customer. Collection via courier can be arranged by contacting us.
8.3 EXCEPTIONS - If your order contains any of the following items, the cooling-off period does not apply and cannot be returned unless faulty.
8.4 Fresh food perishable gifts (such as cheese, meat, fish)
8.5 Personalised and branded goods
8.6 Bespoke hampers. If your hamper is created to your custom requirements.
8.7 Hay Hampers Ltd. reserves the right to withdraw from selling fresh food when unsatisfied that products will remain at a safe temperature during transit due to extremely high temperatures.
9 Damaged and Faulty Goods
9.1 Hampers that are delivered damaged or have defective/damaged contents must be notified to customer services within 7 days of delivery with an image. If required, replacement hampers/items will be sent as soon as possible of the same type or similar.
9.2 If a replacement hamper/item is no longer suitable, a refund or partial refund will be offered. Hay Hampers Ltd. requires the item to be returned before using our return service, for further inspection and investigation.
You confirm that you have read the important section below and our delivery policy.
10.1 UK mainland weekday delivery charges are included in the price for every gift sold by Hay Hampers Ltd., unless for bulk corporate orders. See the Corporate section for more details regarding this. UK Highland and Island deliveries are available for a surcharge for certain gifts.
10.2 Ordering for international* delivery is available from the website for certain gifts using the filter ‘suitable for delivery to’ (*excluding the USA & some others due to customs complexity). Surcharges are calculated and shown when an address is selected at checkout. Please ensure you correctly identify the ‘country’ field.
10.3 It is your responsibility to provide correct, accurate and up to date delivery address details and ensure that your recipient will be available on the date of delivery. If inaccurate details are provided Hay Hampers will not be responsible for the costs of redirection or redelivery. Where goods have been delivered to the given address, Hay Hampers Ltd. cannot accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual receiver refuses or fails to return the item(s).
10.4 Hay Hampers Ltd. are unable to offer product or delivery refunds for failed fresh food deliveries that are due to the recipient not being at home or due to us having been provided with an incorrect delivery address.
10.5 You will receive an email at the point of dispatch with courier tracking details. If you provide the recipient’s correct mobile number the courier will endeavour to send them details of an approximate ETA on the morning of delivery - this is estimated and subject to change. There are also options for them to select if they are not available, such as leave with a neighbour. Leave safe is not an available option for alcohol deliveries. Hay Hampers Ltd. do not deliver to Post Offices or P.O. boxes.
10.6 If the first delivery is not successful, where available the courier will alert the recipient either via a card or SMS. A second delivery will be attempted or collection can be arranged as per the instruction on the courier card. If the carrier doesn’t receive a response to the card/text, they will return the gift to us after 4-5 working days.
10.7 Unfortunately, delivery cannot be made to patients in hospitals or PO Box addresses or similar. For deliveries to employees at hospitals, universities, colleges, military bases, work addresses etc. Please be aware that the driver is required only to deliver to the address on the label – not directly to the recipient and Hay Hampers Ltd. cannot be held responsible for delays incurred from the parcel being delivered to the address and being received by the recipient.
10.8 Orders placed before the daily cut-off time on weekdays can be delivered the next working day (weekday only) except for fresh food/perishable gifts (i.e. scones/cheese/salmon gifts) ordered after 12 pm on Thursday and all gifts ordered over the weekend. These will be dispatched on Monday for delivery Tuesday (see Fresh Food paragraph). UK Bank holidays are NOT working days.
10.9 Fresh Food can only be delivered to mainland UK locations on a Tuesday through to Saturday (no Monday or Sunday deliveries. Hay Hampers Ltd. do not send fresh food items to Overseas addresses.
10.10 Weekend delivery is available for a surcharge.
10.11 Neither Hay Hampers nor our carriers can guarantee any time or date of delivery: there are sometimes events beyond our control that may affect the delivery date and normal transit times. Hay Hampers Ltd. will do everything they can to arrange delivery on the date requested. To minimise possible delays we recommend you select a preferred delivery date.
10.12 Hay Hampers Ltd. do not take any responsibility for delivery failures due to Customs and cannot offer any compensation for this. if in this case, customers must contact customs directly to resolve.
10.13 Whilst every effort will be made to meet customers’ demands, cancellations or variations may be necessary as a result of an Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of Hay Hampers Ltd. If an attempted delivery is not made within an acceptable time, then the customer may cancel the order.
11.1 Hay Hampers Ltd. accepts payment online by Visa, MasterCard, American Express and most debit cards. Please fill in your card number, expiry date and 3 digit security code. Gifts may be ordered and paid for up to three months in advance of delivery to take advantage of discounts or promotional codes.
11.2 All card payments are validated and authorised prior to the completion of your order. Hay Hampers Ltd. are not liable for non-delivery of your goods if your payment is not authorised.
11.3 It is a crime to purchase or attempt to purchase goods with a stolen credit card or with stolen personal details or with a false name. Hay Hampers Ltd. will take appropriate action if any person is discovered attempting to fraudulently purchase goods from the Hay Hampers Ltd. website. Hay Hampers Ltd. reserves the right to withhold goods and terminate any account details with anybody who is suspected of fraudulent practice and/or breach of these terms and conditions.
11.4 VAT and Duty apply at the current rate at the time of invoicing. Hay Hampers Ltd. reserves the right to amend prices according to legislative change. Not every item in a hamper is subject to VAT and therefore hampers may not incur standard VAT at the prevailing rate as the VAT is calculated on a weighted average basis. Hay Hampers Ltd. are responsible for paying import VAT and duty on gifts. It does not fall on Hay Hampers Ltd. if an exported hamper is opened and inspected at customs.
If you enter one of our social media competitions, Hay Hampers Ltd. will assume that you have read these rules and you agree to them.
12.1 To enter a competition you must be (a) a UK resident, and (b) 18 years old or over at the time of entry.
12.2 Competitions are not open to employees (or members of their immediate families) of Hay Hampers Ltd.
12.3 Only one entry per person.
12.4 The winner will be selected at random.
12.5 If a competition is run across Twitter, Facebook, and Instagram, one winner will be chosen across the three platforms unless stated otherwise.
12.6 The closing date is stated on the social media post, and Hay Hampers Ltd reserves the right to amend the competition end date at any time.
12.7 Hay Hampers Ltd. will notify the winner on the same social media channel or via Email (competition dependant) that they entered the competition on.
12.8 By entering the competition the winner agrees to participate in any promotional activity that Hay Hampers Ltd may require.
12.9 No part of a prize is exchangeable for cash or any other prize.
12.10 If an advertised prize is not available, Hay Hampers Ltd. reserves the right to offer an alternative prize of equal or greater value.
12.11 Incorrectly completed entries may be disqualified.
12.12 Hay Hampers Ltd reserves the right to amend these rules at any time. Hay Hampers Ltd may also create rules which will apply to a specific competition only. If Hay Hampers Ltd. do this, amended competition rules and/or specific competition rules on the relevant social media post will be published.
12.13 Hay Hampers Ltd will endeavour to send prizes within a week of the competition winner providing their delivery address but cannot guarantee this delivery time.
12.14 If subscribed to Hay Hampers Ltd. newsletter, Hay Hampers Ltd. may send you promotional codes during the year for special offers and if you use us on a regular basis. You can only enter one promotional code per order.
12.15 Discount codes are permitted to one use and can not be used in conjunction with other offers or promotions unless otherwise stated. Maximum one discount can be applied per order. Discount is subject to eligibility and order value. Hay Hampers Ltd. have the right to withdraw discount codes and promotions at any time without providing reasons.
13 Reviews
13.1 If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
13.2 You grant Hay Hampers the right to use the name that you submit in connection with such content. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.
13.3 You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Hay Hampers.
13.4 The content and material are accurate; Use of the content and material you supply does not breach any applicable Hay Hampers guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory).
14.1 These terms and conditions and all acts of Hay Hampers Ltd., its Directors and employees shall be in accordance with the laws of England. Nothing in these terms and conditions affects your statutory rights.
14.2 If any part of the Terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms.
14.3 These Terms form the entire basis of any agreement reached between yourself and Hay Hampers Ltd.
14.4 We aim to be fully compliant with Natasha's Law and details of ingredients of individual hamper items are displayed on our website on each component page and are available on request. Allergen information is supplied by the product manufacturer and is shown on the manufacturers' packaging. Please notify us if you are ordering a hamper that is NOT specifically marked as allergen suitable for allergen reason (having read the information provided) This is to avoid substitutions being made that are not suitable for your needs. If a hamper is specifically titled as allergen suitable (i.e. Gluten-Free), any substitutions will be suitable.
